Our Privacy Policy and our Data Processing Agreement (available on request) govern how we handle candidate data on your behalf.
We may offer a free trial period (currently 14 days) during which you can access the full or a designated subset of platform features at no charge. At the end of the trial period, continued use of the Service requires a paid subscription. We reserve the right to modify or end free trial offerings at any time.
Paid access to the Service is provided on a subscription basis. Available plans and pricing are displayed on our Pricing page. Subscriptions are charged monthly in advance.
Payment is processed by a PCI-compliant secure payment processing provider. By entering your payment details, you authorise us to charge the applicable subscription fee to your nominated payment method. All fees are quoted in Australian Dollars (AUD) unless otherwise stated.
We may change subscription pricing with at least 30 days' written notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
Prices may be exclusive of GST and other applicable taxes, which will be added where required by law.
The Service, including its software, AI models, user interface, design, text, and all associated intellectual property, is owned by AIWorkerz Pty Ltd or its licensors. Nothing in these Terms grants you any ownership rights in the Service.
You retain ownership of all content you upload to the Service, including job descriptions, company documents, and any data you provide. By uploading content, you grant us a limited, non-exclusive licence to process and store that content solely for the purpose of providing the Service to you.
Any feedback, suggestions, or ideas you provide to us about the Service may be used by us without restriction or obligation to you.
Each party agrees to keep the other party's confidential information confidential and not to disclose it to third parties, except as required by law or with prior written consent. This obligation survives termination of these Terms.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, AIWorkerz disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
AI-generated scores, assessments, and recommendations are provided as tools to assist recruitment decisions. They are not a substitute for human judgement. You are solely responsible for any hiring decisions made using the Service.
To the fullest extent permitted by applicable law, AIWorkerz Pty Ltd and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms will not exceed the total fees paid by you to us in the 12 months immediately preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable Australian Consumer Law, including guarantees relating to services.
You agree to indemnify and hold harmless AIWorkerz Pty Ltd and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; or (d) any claim that data you provided infringes the rights of a third party.
You may terminate your account at any time by cancelling your subscription and closing your account from within your account settings. Upon termination, your access to the Service will cease at the end of your current billing period.
We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms, engage in fraudulent or illegal activity, or if required by law. We may also terminate the Service on 30 days' written notice for any other reason.
Upon termination, your right to use the Service ceases immediately. We will delete or anonymise your account data within 90 days of termination, except where we are required by law to retain it. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. The parties submit to the exclusive jurisdiction of the courts of Queensland, Australia for the resolution of any dispute arising under or in connection with these Terms.
